Regular City Commission Meeting - Minutes
Wednesday, February 12, 2020
CALL TO ORDER: Mayor Gomez called the Wednesday, Feb. 12, 2020, regular City Commission
meeting, being held in Commission Chamber at 7525 NW 88th Avenue, Tamarac, Florida, 33321, to order
at 7:06 p.m.
ROLL CALL: Mayor Michelle J. Gomez, Vice Mayor Marlon Bolton, Commissioner Debra Placko,
Commissioner E. Mike Gelin were in attendance. Commissioner Julie Fishman arrived at 10:21 p.m.
Also present were City Manager Michael C. Cernech, City Attorney Sam Goren and City Clerk Jennifer
Johnson.
Mayor Gomez noted the local elected officials in attendance including, Broward County Mayor Dale
Holness, Broward County Commissioner Michael Udine, Broward County Judge Jackie Powell, City of
North Lauderdale Mayor, Ana Ziade, form Tamarac Mayor Beth Talabisco, and Lauderdale Lakes
Commissioner, Veronica Edwards Phillips.
PLEDGE OF ALLEGIANCE: Commissioner E. Mike Gelin led the Pledge of Allegiance.
Mayor Gomez paused the meeting for a moment of silence in honor of the victims of the Parkland
shooting, which took place February 14, 2018.
1. STATE OF THE CITY
Mayor Gomez introduced the"I Love Tamarac" and 2019 Accomplishment videos.
Mayor Gomez delivered the 2020 City of Tamarac"State of the City" address.
The meeting recessed at 7:43 p.m. to remove equipment.
The meeting reconvened at 7:53 p.m.
2. PROCLAMATIONS AND PRESENTATION
Broward County Mayor Dale Holness, and Broward County Commissioner, Michael Udine, presented
Tamarac Fire Chief, Percy Sayles, a Proclamation in honor of being named Executive Fire Officer of
the Year by the Florida Fire Chiefs' Association.
Mayor Gomez read the following Proclamations, along with her fellow members of the Commission,
presented each recipient with their Proclamation. Copies of Proclamations are kept on file in the City
Clerk's Office.

c. Dr. Jaffus Hardrick— Florida Memorial University
The members of the City Commission also presented Dr. Hardrick with a donation of$1,500, for
FMU.
d. Black History Month
Black History Month Honorees. The City Commission also presented each recipient with a gift
basket.

3 CITY COMMISSION REPORTS
Vice Mayor Bolton provided information related to the meetings he has attended since the last
meeting. Bolton added Happy Birthday to Commission Placko and Commissioner Fishman.
Bolton provided information related to the upcoming Medical Marijuana Summit, which will be
Thursday, Feb. 20, 2020. He added, he would be facilitating the event with the City of Tamarac,
and the event will be supported by the Medical Marijuana Advisory Board so residents and
business can learn more about the medical marijuana. Bolton stated he attended the Lake of
Carriage Hills community meeting with BSO. Members of the Census Bureau also attended, and
Bolton reiterated the importance of everyone needs to be counted in the upcoming census.
Bolton thanked Mayor Holness, and the other dignitaries for attending this evening. Bolton
provided his phone numbers for those that need to contact him, those being, 954-275-3850 and
772-675-0096 or at Facebook.com/MarlonBolton. Bolton welcomed the City Attorney and City
Clerk to the meeting.
Commissioner Gelin requested clarification about the process for bringing items forward in the
future. City Attorney, Sam Goren, clarified that a member of the Commission may speak on any
item that is on the agenda, but Broward County passed a 48-hour rule mandating items be
placed on an agenda publicly. There are limitations, the public has a right to know what the
Commission will be acting on; therefore, the process is for Commissioners to email the City
Clerk's Office at least six (6) days prior to the meeting to having an item placed on the agenda.
Any Commissioner may talk about issues they choose, but in so far as items that are to be

considered for direction or action, you would need to follow the process. Goren read the
instructions directly from the City's Ordinance. Gelin asked Goren to research the votes taken
the Ban the Box and Paris Agreement topics, at the previous meeting, and to get back with him
on if they need to be brought back in accordance with the process.
Commissioner Placko asked for clarification regarding topics for a workshop. City Attorney, Sam
Goren, clarified Florida law requires can vet many issues as a workshop, then take it to a
meeting for formal action on an agenda. The timeframe for bringing items forward for a workshop
is not the same as a formal agenda.
Mayor Gomez said Happy Birthday to both Commissioner Placko and Fishman. She
commended Vice Mayor Bolton regarding his comments on the census. Gomez also expressed
her gratitude to Kathleen Gunn, City staff, and everyone who helped make tonight a success,
and it's an honor being your Mayor. She wished everyone a Happy Valentine's Day; full of love,
keeping in mind those who have had a big loss in their lives this day, but still have love in their
hearts.
4. CITY ATTORNEY REPORT
City Attorney, Sam Goren, stated we submitted our legislative action pending in Tallahassee the
second week of February. There are bills this year, that are an assault on homerule and pre-emption
issues. Goren offered to answer any questions about the report, and as things proceed.
5. CITY MANAGER REPORT
None.
6. PUBLIC PARTICIPATION
a. Natasha Britton, stated she lives in Woodmont, and commended the City on great presentations
tonight. Britton asks the members of the Commission to remind the community to lock their car
doors and take out their valuables. Mayor Gomez reminded everyone to also remove their garage
door openers.
b. Debbie Taylor, of 7850 W. McNab Road, Tamarac, commended the City on the presentations at
the meeting. Taylor asked why the City stopped recycling glass and if there was an alternative.
Public Services Director, Jack Strain, stated Waste Management is longer recycling, and it is
being stored on sight at Waste Management. The City therefore made the decision to stop
recycling glass, have residents throw it away, because it was no longer cost effective for the City.
The City would like to recycle glass, but is not a option at this time.
c. Ronald Wasserman, of 8577 Jade Drive, Tamarac, expressed his gratitude to Sheriff Tony for
hosting a Community Meeting. Special appreciation to Capt. Cirminello, Broward Sheriffs Office,
for immediately responding to my meeting request, meeting with me and addressing my concerns
regarding speeding on Southgate Blvd. Wasserman thanked his County Commissioner, and his
Chief of Staff, Kyle Shulberg. He thanked members of the Commission and the City Manager for
meeting with him. Wasserman also thanked the Veterans for their sacrifice.
d. Dania Bernard, 7030 Marbury Lane, Tamarac, stated she is full-time caregiver to her
handicapped father. She asked if there will be any opportunity for those have limited access to
use recreational facilities. Mayor Gomez added their other parks that do have ADA facilities at the
Mainlands Park. Parks & Recreation Director, Greg Warner, stated the new fitness area at
Waters Edge Park is accessible, and there will be some pieces available for wheelchair access.

7. CONSENT AGENDA
Mayor Gomez asked City Manager Cernech if there were any items to be added or deleted from the
Consent Agenda. Cernech replied, no.
Commissioner Placko made a motion to approve the Consent Agenda. Mayor Gomez passed the
gavel to Vice Mayor Bolton, and seconded the motion. The motion carried unanimously 4-0, with
Commissioner Fishman being excused.

b. TR13391 - Ferguson Group LLC -Agreement Amendment#11
A Resolution of the City Commission of the City of Tamarac, Florida; approving Amendment#11 to
the Agreement between the City of Tamarac and the Ferguson Group, LLC, for Federal lobbying
services, extending the term of the agreement for a one year period effective February 13, 2020 at a
cost not to exceed eighty-five thousand five hundred ($85,500.00) dollars per year; authorizing the
appropriate City Officials to execute Amendment#11 to the agreement; providing for conflicts;
providing for severability; and providing for an effective date.

c. TR13393 -Appointing one (1) Resident Trustee to the Tamarac Police Pension Board
A Resolution of the City Commission of the City of Tamarac, Florida, appointing one Resident Trustee
to the Police Pension Board effective immediately, providing for conflicts; providing for severability;
and providing for an effective date.

d. TR13394 -Approve and authorize Citywide LED Light Replacement Program, Phase II
A Resolution of the City Commission of the City of Tamarac, Florida, approving replacement of City
owned street lights; authorizing an expenditure of funds for an amount not to exceed the approved
annual budget; utilizing ITB no. 16-17-029 solicited and awarded by the City of Miami Gardens,
Florida, as the Lead Agency for the Southeast Florida Governmental Purchasing Cooperative Group;
effective upon approval through November 8, 2020 or as extended by the City of Miami Gardens on
behalf of the Southeast Florida Governmental Purchasing Cooperative; authorizing the proper City
Officials to execute Contract Renewals; providing for conflicts; providing for severability; and
providing for an effective date.

e. TR13385 - Safeguard -Vacation of Easement
A Resolution of the City Commission of the City of Tamarac, Florida, approving a Vacation of
Easement petition to vacate a portion of one (1) Public Water Utility Easement located on the
Safeguard Self-Storage property more specifically located at 6101 W. Commercial Boulevard as
further described in the legal description attached hereto as Exhibit"A"; (Case No. 2-P-18); providing
for conflicts; providing for severability; and providing for an effective date.

f. TR13395 - HOME—Approval of Interlocal Agreement- FY 2019/2020
A Resolution of the City Commission of the City of Tamarac, Florida, accepting the 2019-2020 Fiscal
Year Home Investment Partnership ("HOME") funds in the amount of$135,457 for a term

retroactively commencing October 1, 2019 with an end date of September 30, 2021; authorizing the
appropriate City Officials to execute an Interlocal Agreement between Broward County and the City of
Tamarac for the designation of subrecipient and providing for disbursement of HOME Program
Funds for the Owner-Occupied Minor Home Repair Program, Fiscal Year 2019-2020, attached hereto
as Exhibit"A", and incorporated herein; providing for conflicts; providing for severability; and providing
for an effective date.

g. TR13396 -Authorize purchase of horticultural chemicals
A Resolution of the City Commission of the City of Tamarac, Florida approving the purchase of
horticultural chemicals; authorizing the appropriate City Officials to select, approve and award the
purchase of horticultural chemicals annually utilizing competitive procurement methods with
prequalified vendors; authorizing an annual expenditure from the appropriate accounts not to exceed
the approved annual budget for said purpose; providing for conflicts; providing for severability; and
providing for an effective date.

h. TR13397 -Sunset Point Park/Veteran's Park Improvements
A Resolution of the City Commission of the City of Tamarac, Florida, awarding RFQ No. 19-26Q to
and approving an Agreement with CPZ Architects, Inc. For the Design of Sunset Point and Veterans
Park Renovations at a contract cost of$258,705.00, a contingency in the amount of$25,870.50 (10%
of the contract cost) will be added to the project account, for a total project budget of$284,575.50;
providing for conflicts; providing for severability; and providing for an effective date.

i. TR13398- Purchase of Waste Water Lining Services
A Resolution of the City Commission of the City of Tamarac, Florida approving the purchase of
wastewater Lining services for wastewater mainline, laterals, and manholes, not to exceed the annual
budgeted amount for said services; and authorize the appropriate City Officials to select, approve,
and award the purchase of said services utilizing competitive procurement methods including, but not
limited to, Vortex Services, LLC utilizing City of Tallahassee Contract No. 4523; SAK Construction,
LLC, utilizing City of Port Saint Lucie Contract No. 20180197; and BLD Services, utilizing City of
Largo Bid No. 19-b-645 in an amount not to exceed the approved annual budget for said purpose;
providing for severability; and providing for an effective date.

j. TR13400 -Grant Award - Federal Emergency Management Agency (FEMA)
A Resolution of the City Commission of the City of Tamarac, Florida accepting a Hazard Mitigation
Grant Program (HMGP) award from the Florida Division of Emergency Management(FDEM) through
the Federal Emergency Management Agency (FEMA) for the City of Tamarac Lift Station Generator
Project in the amount of$431,668.50; authorizing the appropriate City Officials to execute a grant
agreement and necessary documents pending legal review between FDEM and the City of Tamarac
for HMGP grant funding in the amount of$431,668.50; providing for up to a 25% match in local funds
in an amount not to exceed $143,889.50; providing for conflicts; providing for severability; and
providing for an effective date.

k. TR13401-Tamarac 2020 Federal Legislative Agenda
A Resolution of the City Commission of the City of Tamarac, Florida, approving the City of Tamarac
2020 Federal Legislative Agenda; directing the City Clerk to transmit a copy of the City of Tamarac
2020 Federal Legislative Agenda to the National League of Cities, the U.S. Senators from Florida,
Florida Congressional Delegation and the Broward County Board of County Commissioners;
providing for conflicts; providing for severability; and providing for an effective date.

I. TR13402 - Lauderdale Lakes Support for NW 31st Avenue Transportation
A resolution of the City Commission of the City of Tamarac, Florida, supporting the Broward
Metropolitan Planning Organization (MPO) and the City of Lauderdale Lakes in its effort to coordinate
the transportation planning for the NW 31 Avenue Transportation/Transit Related Corridor
Improvement project from Broward Boulevard to Commercial Boulevard; providing for conflicts;
providing for severability; and providing for an effective date.

8. REGULAR AGENDA
a. TR13403 - Bid Authorization for Tax Deed Auction
A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the City Manager to
take all necessary action to participate in the tax deed auction for the property located at 4959 N.
State Road 7 for a total purchase price not to exceed One Million Four Hundred Thousand Dollars
($1,400,000.00); providing for conflicts; providing for severability; and providing for an effective date.
City Attorney, Sam Goren, read the title for the record. Director of Economic Development, Lori
Funderwhite, presented the item.
Commissioner Placko motioned to approve. Commissioner Gelin seconded. Motion carried
unanimously 4-0, with Commissioner Fishman being excused.
9. ORDINANCE(S) —FIRST READING
a. TO2424 -Amendment to the Tamarac Procurement Code
An ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 6 of the
City's Code of Ordinances entitled "Finance and Taxation", specifically amending Article V Entitles
"Tamarac Procurement Code" by updating and modernizing existing procurement means and
methods; creating a veteran's preference; providing for codification; providing for Conflicts; providing
for severability; providing for an effective date.

City Attorney, Sam Goren, read the title for the record. Contracts and Procurement Director, Keith
Glatz, presented the item.
Discussion by the Commission ensued related to increasing the Veterans Preference points from 2.5
to 5, and allowing for vendors to be awarded points in the aggregate, such as women owned and
veteran's preference. The consensus of the Commission is to establish a measurement process the
preference, and determine an increase in points is necessary later.

Commissioner Gelin motioned to approve. Vice Mayor Bolton second. The motion carried
unanimously 5-0.

a. TO2422 -Amending Code Relating to Sister Cities Committee
An Ordinance of the City Commission of the City of Tamarac, Florida; amending Chapter 2,
"Administration,"Article III, "Boards, Committees, Commissions" of the Tamarac Code of Ordinances,
by amending Sections 2-234.32 through 2-234.40, "Sister Cities Committee" providing for process for
appointments and residency provision; providing for severability; providing for codification and
providing for an effective date.
City Attorney, Sam Goren, read the title for the record.
Mayor Gomez opened for comments from the public. None.
Vice Mayor Bolton motioned to approve. Commissioner Placko seconded. The motion carried
unanimously 5-0.
