R-2020- l A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING RESOLUTION R-2020-058 REGARDING THE LOCATION OF THE PLACE FOR THE PUBLIC HEARINGS TO SET THE TENTATIVE AND FINAL MILLAGE RATES AND BUDGETS FOR FISCAL YEAR 2021; CONFIRMING THAT THE SEPTEMBER 14, 2020 HEARING FOR THE TENTATIVE MILLAGE AND BUDGET FOR FISCAL YEAR 2021 AND THE SEPTEMBER 29, 2020, HEARING ON THE CITY'S MILLAGE AND BUDGET FOR FISCAL YEAR 2021 WILL OCCUR USING COMMUNICATIONS MEDIA TECHNOLOGY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on July 8, 2020, the City Commission adopted Resolution R-2020- 058, which among other things established the City's proposed millage rate and scheduled the date, time and location for the first public hearing to set the City's tentative millage rate and budget, to be on September 14, 2020, at 5:05 p.m., in the City Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321, and the second public hearing to set the City's millage rate and budget to be on September 29, 2020, at 5:05 p.m., in the City Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321; and, WHEREAS, due to the ongoing statewide emergency regarding the COVID-19 virus, on July 29, 2020, Governor DeSantis issued Executive Order 20-179, which extended and amended Executive Order 20-69 to permit local governments to conduct Temp Reso # 13483 August 26, 2020 Page 2 their millage and budget public hearings, as well as special assessment hearings, through the use of communications media technology (CMT) through October 15, 2020; and, WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the health and safety of the citizens and residents of the City of Tamarac to conduct its public hearings for adoption of its millage rate and budget for Fiscal Year 2021 through CMT. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing 'WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution. SECTION 2: Section 3 of Resolution R-2020-058 is amended to provide that the first public hearing to set the City's tentative millage rate and tentative budget for Fiscal Year 2021 shall be September 14, 2020, at 5:05 p.m., and the hearing shall be at a virtual City Commission meeting using CMT, and can be accessed at www.tamarac.orq/meetings. SECTION 3: Section 4 of Resolution R-2020-058 is amended to provide that the second public hearing to adopt the millage rate and budget for Fiscal Year 2021 shall be September 29, 2020, at 5:05 p.m. and the hearing shall be at a virtual City Commission meeting using CMT, and can be accessed at www.tamarac.orq/meetings. . SECTION 4: All resolutions or parts of resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is Temp Reso # 13483 August 26, 2020 Page 3 held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of the Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED THIS DAY OF AUGUST 2020. MICHELLE J.
