A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, RELATING TO THE PROVISION
OF STORMWATER MANAGEMENT PROVIDED BY THE
CITY'S STORMWATER UTILITY IN THE CITY OF
TAMARAC, FLORIDA; AMENDING RESOLUTION R-2020-
060 REGARDING THE LOCATION OF THE PLACE OF THE
PUBLIC HEARING FOR THE PROPOSED STORMWATER
UTILITY MANAGEMENT FEES AND THE FEE ROLL FOR
FISCAL YEAR 2021; CONFIRMING THAT THE
SEPTEMBER 14, 2020, PUBLIC HEARING WILL OCCUR
USING COMMUNICATION MEDIA TECHNOLOGY (CMT);
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on July 8, 2020, the City Commission adopted Resolution R-2020-
060, which among other things scheduled the date, time and location for the public
hearing to establish the annual stormwater utility management fees and adopt the fee roll
for such to be on September 14, 2020, at 5:05 p.m., in the City Commission Chambers,
7525 N.W. 88th Avenue, Tamarac, Florida 33321; and,
WHEREAS, due to the ongoing statewide emergency regarding the COVID-19
virus, on July 29, 2020, Governor DeSantis issued Executive Order 20-179, which
extended and amended Executive Order 20-69 to permit local governments to conduct
their special assessment hearings through the use of communications media technology
(CMT) through October 15, 2020; and,
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the health and safety of the citizens and residents of the City of
Tamarac to conduct its public hearings for the adoption of its special assessment rolls
through CMT.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution.
SECTION 2: Article IV, Section 4.01 of Resolution R-2020-060 is amended to
provide that the public hearing on the Stormwater Utility Management Fees and the
adoption of the fee roll for such for Fiscal Year 2021 shall be September 14, 2020, at 5:05
p.m., and the hearing shall be at a virtual City Commission meeting using CMT, and can
be accessed at www.tamarac.orcilmeetings. The form of published notice shall be
updated to provide for the virtual public hearing using CMT.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
resolution.

SECTION 5: This Resolution shall take effect immediately upon its passage and
adoption.
