R-2020 - 1.C7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A VACATION OF EASEMENT PETITION IN AN EFFORT TO VACATE SIX (6) EASEMENTS ASSOCIATED WITH DRAINAGE, WATER, SEWER AND UTILITIES & SEVEN (7) NEW EASEMENTS THAT ARE REQUIRED ON THE SOUTH OF MCNAB ROAD AND EAST SIDE OF N.W. 88 AVE/ N PINE ISLAND ROAD AS FURTHER DESCRIBED IN THE LEGAL DESCRIPTION ATTACHED HERETO AS EXHIBIT "1" EASEMENT VACATION EXHIBITS; (CASE NO. 3-P-20); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ronald Stein, the designated agent for the property owner, City of Tamarac, has requested a Vacation of Easement application in order to vacate six (6) easements lying in a parcel of land as described in the legal descriptions within the attached surveys (Exhibits 8 — 13) and the addition of seven (7) new easements lying in a parcel of land as described in the legal descriptions within the attached surveys (Exhibits 1-7 and incorporated herein and made a specific part thereof); and WHEREAS, the City Engineer has been contacted and has stated no objection to the Vacation of Easements and Creation of New Easements; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the Vacation of Easement and Creation of New Easement application in order to vacate six (6) easements and add seven (7) new easements dedicated to the City lying in a parcel of land as described in the legal descriptions within the attached surveys (Exhibit 1-13), Temporary Resolution No. 13499 October 14, 2020 Page 2 attached hereto are incorporated herein and made a specific part thereof; located on a parcel of land South of West McNab Road and East of N.W. 88th Avenue/ N Pine Island Road, in order to accommodate the Colony West Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: That the six (6) easements dedicated to the City lying in a parcel of land located near the South of McNab Road and East of N.W. 88th Avenue/ N Pine Island Road, IS HEREBY vacated. In Addition, the seven (7) new easements dedicated to the City lying in a parcel of land located near the South of McNab Road and East of N.W. 88th Avenue/ N Pine Island Road, IS HEREBY approved. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption. Grant of Access Easement: 3.1 Each of Colony and Rack hereby grants, assigns and conveys to Colony, Associates and Rack, and their respective agents, employees, tenants, subtenants, licensees and invitees(collectively,the"Permittees"),in common with others entitled to use the same,a perpetual, non-exclusive easement(the "Access Easement") fbr the passage (but not parking) of passenger, service and delivery vehicles over and across those portions of the Colony Property and the Rack Properties which are,from time to time,paved,to provide access between the Colony Property,the Associates Property and the Rack Properties to McNab Road and Pine Island Road,and over curb cuts and access points as they may from time to time exist;however,the Access Easement shall not include ingress and egress for construction vehicles. 4.
