Ord. #2439 October 15, 2020 Page 1 of 3 ORDINANCE NO. 0-2020-O I AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, PERTAINING TO LIVING WAGES; CREATING PROVISIONS FOR LIVING WAGE FOR CITY EMPLOYEES; AMENDING CHAPTER 6 OF THE CITY'S CODE OF ORDINANCES, ENTITLED "FINANCE AND TAXATION", SPECIFICALLY AMENDING ARTICLE I, ENTITLED "IN GENERAL" BY CREATING SECTION 6-1, TO BE ENTITLED "TAMARAC EMPLOYEE LIVING WAGE"; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Commission is concerned that the wages paid to the employees of the private companies may not be enough for them to support and care for their families, thereby inhibiting employee retention and negatively impacting the quantity and quality of services rendered by these employees to the City and the public; and WHEREAS, the City Commission is equally concerned that City employees earn a wages that it deems sufficient to support and care for their families; and WHEREAS, the City Commission of the City of Tamarac has determined that amending the Code to include a living wage for its employees is in the best interests of the individual and corporate citizens of the City of Tamarac. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing WHEREAS clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: The City Commission of the City of Tamarac hereby amends Chapter 6 of the City's Code Of Ordinances, entitled "Finance and Taxation", specifically amending Article I, entitled "In General", by creating section 6-1, to be entitled "Tamarac Employee Living Wage", as follows: Section 6-1. Tamarac Employee Living Wage. All full and part time employees of the City shall be paid a living wage, which is the minimum hourly income that the City Commission determines to be necessary for an individual to support themselves and to pay basic living expenses such as food, medical care, housing and transportation costs. Ord. #2439 October 15, 2020 Page 2 of 3 living wage shall be determined by the City Commission by resolution. The City Commission may amend the living wage annually, subject to collective bargaining, if required. SECTION 4: It is the intention of the City Commission of the City of Tamarac, Florida that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, re-lettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 5: If any clause, section, or other part or application of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the remaining portions or applications remaining in full force and effect. SECTION 6: All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict.
