R-2020 - /2* A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING THE BROWARD METROPOLITAN PLANNING ORGANIZATION (MPO) TO URGE THE FLORIDA DEPARTMENT OF TRANSPORTATION TO MAINTAIN THE FULL PROJECT FUNDING FOR DESIGN, CONSTRUCTION ENGINEERING & INSPECTION FOR PROJECTS ADMINISTERED UNDER THE LOCAL AGENCY PROGRAM AND OTHER GRANT FUNDED PROGRAMS; DIRECTING THE CITY CLERK TO FORWARD A COPY OF THIS RESOLUTION TO DESIGNATED PARTIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, during recent MPO board meetings, it was brought to the members attention that the Florida Department of Transportation (FDOT) will no longer administer grants where activities are not taking place on State roads; and WHEREAS, the Broward Metropolitan Planning Organization (Broward MPO) board members were also advised that in order for municipalities to participate in funding programs such as Complete Streets and Localized initiative Program (CSLIP) and Complete Streets Master Plan (CSMP), the municipalities must be Local Agency Program (LAP) certified, enabling them to manage their own program; and WHEREAS, the process of becoming LAP certified is long, tedious and expensive; and WHEREAS, these changes also make it necessary for the municipalities to fund the design, construction engineering and inspection phases of the projects, creating a financial burden for many municipalities; and WHEREAS, the Directors of Community Development and Public Services Temporary Resolution No. 13536 November 19, 2020 Page 2 r recommends approval, and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to support the Broward MPO to urge FDOT to maintain the full project funding for design, construction engineering and inspection for projects administered under the Local Agency Program and other grant funded programs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing recitals contained in the preamble to this Resolution are incorporated by reference herein. SECTION 2: That the City Commission requests the Florida Department of Transportation to maintain its previous commitment to fully fund all phases projects approved under the Broward Metropolitan Planning Organization Complete Streets and other Localized Initiatives Program used to prioritize federal funds pursuant to 23 USC 134. SECTION 3: That the City Clerk is directed to forward a copy of this Resolution to Congressman Alcee L. Hastings, State Representative Robin Bartleman, Secretary of the Florida Department of Transportation, Florida Department of Transportation District Four, the Broward Metropolitan Planning Organization and the governing bodies of Broward County municipalities. SECTION 4: That the appropriate City officials are authorized to execute all Temporary Resolution No. 13536 November 19, 2020 Page 3 necessary documents and to take any necessary action to effectuate the intent of this Resolution. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7: This Resolution shall become effective immediately upon its adoption.
