R-2020 - IQ60 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, URGING THE UNITED STATES CONGRESS AND THE PRESIDENT TO EXTEND THE DEADLINE FOR THE EXPENDITURE OF THE CARES ACT FUNDS; DIRECTING THE CITY CLERK TO SHARE A COPY OF THIS RESOLUTION WITH THE APPROPRIATE PARTIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 13, 2020 the President of the United States, declared the COVID-19 outbreak in the United States a national emergency, beginning March 1, 2020; and WHEREAS, The Coronavirus Aid, Relief, and Economic Security (CARES) Act was passed by Congress with overwhelming, bipartisan support and signed into law by President Trump on March 27th, 2020; and WHEREAS, the December 30, 2020 deadline to expend the CARES Act funds is rapidly approaching; and WHEREAS, the City of Tamarac, as a subrecipient of the Coronavirus Relief Fund moneys from Broward County on a reimbursement basis and from Florida Housing Coalition, has been working around the clock to provide assistance to Tamarac residents and small businesses and implement safety measures for public facilities and spaces; and Temp. Reso. #13537 November 19, 2020 Page 2 of 4 WHEREAS, the economic and public health crises caused by the COVID- 19 pandemic continue to impact communities nationwide; and WHEREAS, due to the extended ongoing nature of the health and economic crises, residents and businesses in Tamarac and nationwide continue to need assistance; and WHEREAS, the Director of Financial Services and the Assistant City Manager recommend urging the United States Congress and the President of the United States to extend the deadline for the expenditure of the CARES Act funds, so we can continue to serve those in need; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the citizens and residents of the City of Tamarac to urge the United States Congress and the President of the United States to extend the deadline for the expenditure of the CARES Act funds. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Temp. Reso. #13537 November 19, 2020 Page 3 of 4 SECTION 2: The City Commission urges the United States Congress and the President of the United States to extend the deadline for the expenditure of the CARES Act funds. SECTION 3: The City Clerk is hereby directed to share a copy of this resolution with the U.S. Senator Scott, the U.S. Senator Rubio, the U.S. Representative Hastings, the Florida League of Cities, the Broward League of Cities, and the Broward County Legislative Delegation. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
