R-2021 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, CONDEMNING THE VIOLENT ATTACK AT THE U.S. CAPITOL DURING THE TABULATION OF THE ELECTORAL COLLEGE VOTES; AND FURTHER CONDEMNING THE ACTIONS OF ANY INDIVIDUALS, INCLUDING ELECTED OFFICIALS AND ANY PRESIDENT OF THE UNITED STATES, THAT ENCOURAGED THE ATTACK AT THE U.S. CAPITOL ON JANUARY 6, 2021; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the hallmark of democracy is the peaceful transition of power by elected officials; and WHEREAS, the current procedure to assure that votes of the Electoral College are tabulated in an open and transparent way is outlined in the Electoral Count Act; and WHEREAS, the United States Capitol is the seat of our government which embodies our tradition of open, transparent and democratic government; and WHEREAS, on January 6, 2021, an attack on the United States Capitol building temporarily halted the ceremonial tabulation of the Electoral College votes in an unprecedent assault upon United States democracy and the peaceful transition of government in the United States. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac: (1) condemns the violent attack at the United States Capitol on January 6, 2021; (2) condemns the actions of any individual, including elected officials and any President of the United States, who aids and abets the attack at the United States Capitol; (3) reaffirms support for the peaceful transition of power; and (4) reaffirms, in the strongest terms, its support for and commitment to the United States Constitution. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. 01/13/2021 Page 2 of 2 SECTION 4: If any clause, section, other part or application of this Resolution is • held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
