R-2021 G A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, IN SUPPORT OF THE CITY OF SUNRISE'S COMPLETE STREETS TAMARAC COLLABORATIVE PROJECT - NW 94TH AVENUE TO ADD BIKE LANES, SIDEWALKS, CURBS AND GUTTERS ALONG NW 94TH AVENUE WITHIN THE CITY OF SUNRISE'S RIGHT OF WAY AND THE CITY OF TAMARAC RIGHT OF WAY, BETWEEN COMMERCIAL BOULEVARD AND NW 57TH STREET; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac desires to provide a safe connectivity between city facilities, schools, shopping areas, residential areas and the Broward County Greenway system by establishing an integrated bikeway/walkway system throughout the City; and WHEREAS, pursuant to Resolution No. R-2018-147, the City Commission authorized support of the City of Sunrise's Complete Streets and Other Localized Initiatives Program (CSLIP) Application to add bike lanes, sidewalks, curbs and gutters along NW 941h avenue within the City of Sunrise's Way and the City of Tamarac Right of Way, between Commercial Boulevard and NW 57th Street; and WHEREAS, the Broward Metropolitan Planning Organization (MPO) approved the Complete Streets and other Localized Initiatives Program (CSLIP) on July 9th, 2015; and WHEREAS, Tamarac Collaborative Project NW 94th Avenue was evaluated and ranked by the MPO, then vetted to determine programmability in accordance to the CSLIP 0 policies; and Temp. Reso. # 13557 January 27, 2021 Page 2 WHEREAS, a resolution from the City of Tamarac Commission stating support for the project is required to establish funding eligibility; and WHEREAS, the project is programmed in Broward MPO's currently adopted fiscal year 2021-2025 Transportation Improvement Program (TIP) using federal funds; and WHEREAS, federally funded projects off the state highway system are delivered using the federally mandated Local Agency Program (LAP) process; and WHEREAS, the City of Tamarac endorses the City of Sunrise to administer and deliver the project under LAP; and WHEREAS, the City of Tamarac commits to coordinate with the City of Sunrise to determine any required funding commitments for the upfront costs for design, Construction Engineering and Inspection (CEI) services, and construction, for the portion 0 of the project located within the City of Tamarac Right of Way, to be then reimbursed as per requirements of LAP; and WHEREAS, the City of Tamarac commits to coordinate with the City of Sunrise to determine any required funding commitments for construction contingency, for the portion of the project located within the City of Tamarac Right of Way, per the requirements of LAP; and WHEREAS, Tamarac Collaborative Project NW 94th Avenue will be constructed within the City of Sunrise's Right of Way and the City of Tamarac's Right of Way; and WHEREAS, it is the responsibility of City of Tamarac, to maintain or coordinate the maintenance of the roadways, for the portion of the project located within the City of Tamarac Right of Way, after the project's completion; and 0 is • Temp. Reso. # 13557 January 27, 2021 Page 3 WHEREAS, the project is expected to aid in City's Strategic Goal #5, "A Vibrant Community", which states, "The City of Tamarac will provide resources, initiatives and opportunities to continually revitalize our community and preserve the environment"; and WHEREAS, the proposed project supports current efforts to enhance multi -modal transportation, wellness and recreational opportunities throughout Tamarac, and is consistent with the transportation element of the City of Tamarac's Parks and Recreation and Social Services Master Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac does HEREBY support the City of Sunrise's Complete Streets Tamarac Collaborative Project - NW 94th Avenue, to add bike lanes, sidewalks, curbs and gutters along NW 94th avenue within the City of Sunrise's Right of Way and the City of Tamarac Right of Way, between Commercial Boulevard and NW 57th Street. SECTION 3: All Resolutions or parts of Resolutions in conflict herewithare hereby repealed to the extent of such conflict. • SECTION 4: If any clause, section, other part or application of this Temp. Reso. # 13557 January 27, 2021 Page 4 Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, • in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
