Ord. #2445 November 18, 2020 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 2021- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 2, "ADMINISTRATION," ARTICLE III, "BOARDS, COMMITTEES, COMMISSIONS," OF THE CITY OF TAMARAC CODE OF ORDINANCES, BY CREATING DIVISION 4, "DIVERSITY, EQUITY AND INCLUSION ADVISORY BOARD"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac (the "City") desires to encourage full participation by all individuals of all backgrounds who are interested in being appointed to City Advisory Boards; and WHEREAS, the City is one of South Florida's most diverse cities; and WHEREAS, strengthening community connections among diverse groups, fostering cultural activity, and creating inclusion projects and programs will enhance life and activity within the City; and WHEREAS, over the years, citizens have donated countless hours to make thoughtful recommendations to the City Commission about how best to move forward with ethnic community engagement within the City; and WHEREAS, the City Commission finds that recognizing and formalizing the Diversity, Equity and Inclusion Advisory Board into a formal City Advisory Board is in the best interests of the citizens and residents of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2. The City Commission hereby amends Chapter 2, "Administration," Article III, `Boards, Committees, Commissions," of the City of Tamarac Code Of Ordinances, by creating Division 4, "Diversity, Equity and Inclusion Advisory Board" to read as follows: CODING: Words in strike +►,m ugh type are deletions from existing law; Words in underlined type are additions. Ord. #2445 November 18, 2020 Page 2 42 DIVISION 4. - DIVERSITY, EQUITY AND INCLUSION ADVISORY BOARD • 43 Sec. 2-136. - Created; composition. 44 There is hereby created a Diversity, Equity and Inclusion Advisory Board of the City, which shall 45 consist of five (5) regular members, serving without pay, appointed by the City Commission. The 46 mission of this board is to promote awareness and to celebrate the rich heritage and the vast 47 diversity of the City of Tamarac. 48 49 Sec. 2-137. — Residency requirements. 50 51 Each member of the Board shall be a resident of the City or an owner or employee of a business 52 located in the City. Failure to be a resident of the City or employed by a business located in the 53 City shall result in forfeiture of the position on the Board. The City Commission may waive the 54 requirements of this section. 55 56 Sec. 2-138. Appointment process; terms; annual review. 57 58 The appointment process shall occur in accordance with the terms and provisions of sections 2-57 59 and 2-58 of the City Code. Terms of appointees shall occur in accordance with the terms and 60 provisions of section 2-59 of the City Code. The annual review shall occur in accordance with the 61 terms and provisions of section 2-60 of the Cily Code. 62 63 Sec. 2-139. — Duties and Responsibilities. 64 65 The Diversity, Equity and Inclusion Advisory Board shall have the following duties and 66 responsibilities: 67 68 a. The Board will make recommendations to the City Commission on diversity and 69 equity strategies that strengthen connections among diverse communily groups and 70 with city government 71 72 b. The Board will advise on initiatives that will promote appreciation, acceptance and 73 respect for cultural and ability differences. These initiatives will contribute to City 74 services and programs being equitable and accessible for all. 75 76 c. The Board will make recommendations to the City Commission, on ways to work 77 with public and private stakeholders in the City to increase understanding of the 78 diverse groups that make up the City. 79 80 Sec. 2-140. - Meetings. Ord. #2445 November 18, 2020 Page 3 el 82 The Advisory Board shall meet at least once a month at the regularly scheduled time which is to 83 be approved by the City Clerk; the Board may determine annually its own vacation period not 84 to exceed more than one (1) cancelled meeting per year. A quorum shall consist of a majority 85 of the membership. 86 87 Sec. 2-141. — Vacancies 88 89 a. Removal of members. A Board member appointed by the City Commission serves at 90 the pleasure of the City Commission and shall be removed at any time by majority 91 vote of the City Commission. 92 93 b. Resignation of members. A resignation by a Board member made either orally 94 writing will be deemed accepted by the City Commission when the Board member 95 announces his or her resignation to the City Commission, City Manager or City 96 Commission. The City Commission need not take any formal action to accept the 97 resignation. Failure to attend three (3) consecutive meetings without being excused 98 by the chairperson shall be deemed a resignation. 99 100 SECTION 3. It is the intention of the City Commission of the City of Tamarac that the 101 provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the �2 City of Tamarac, Florida, and that the Sections of this ordinance may be renumbered, re -lettered 3 and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in 104 order to accomplish such intention. 105 106 SECTION 4. If any clause, section, or other part or application of this Ordinance shall be 107 held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional 108 or invalid part or application shall be considered as eliminated and so not affecting the validity of 109 the remaining portions or applications remaining in full force and effect. 110 111 SECTION 5. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions 112 in conflict herewith be and the same are hereby repealed to the extent of such conflict. 113 114 SECTION 6.
