Ord. #2449 01/12/2021 Page 1 of 4 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2021- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 15 OF THE TAMARAC CODE, ENTITLED "PARKS AND RECREATION", ARTICLE II, "ADMINISTRATION", DIVISION 2, "PARKS AND RECREATION BOARD", SECTION 15-43, TO HAVE APPOINTED MEMBERS OF THE BOARD SERVE TERMS CONCURRENT WITH THEIR APPOINTING COMMISSIONER AND THE CHAIRPERSON SHALL BE SELECTED BY THE MAJORITY OF THE MEMBERS OF THE BOARD TO SERVE A TERM OF ONE YEAR; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING • FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code provides that the Parks and Recreation Board shall consist of five (5) members appointed by the City Commission; and WHEREAS, to be consistent with §2-59(a) of the City Code of Ordinances; members of the Board shall serve terms concurrent with their appointing Commissioner, or until such time new appointments are made; and WHEREAS, to be consistent with §2-31(a) of the City's Code of Ordinances that each board, commission or committee whose members are appointed by the city commission shall annually meet to appoint a chairperson, vice-chairperson and a second vice-chairperson unless otherwise provided in this Code. If the chairperson or vice-chairperson ceases to be a member of the board, commission or committee during his term of office, the remaining members shall select a new chairperson or vice-chairperson, as appropriate, for the balance of the term. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof; all exhibits attached hereto are incorporated herein and made a specific part thereof. SECTION 2: That Chapter 15 of the Tamarac City Code, entitled "Parks • and Recreation", Article II, "Administration", Division 2, "Parks and Recreation Board" is hereby amended as follows: Sec. 15-43. - Membership. Board members appointed by the city commission shall annually meet to appoint a chairperson, vice-chairperson and second vice-chairperson. If the chairperson, vice- chairperson or second vice-chairperson ceases to be a member of the board, commission or committee during his term of office, the remaining members shall select a new chairperson, vice-chairperson or second vice-chairperson, as appropriate, for the balance of the term. Each year, the vice-chairperson will move into the chairperson role, the second vice-chairperson will move to the vice-chairperson role and a new second vice- chairperson will be selected. A chairperson cannot serve successive terms and cannot be selected to be chairperson again until all other board members have had the opportunity to serve as chairperson. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. • CODING: Words in struck through type are deletions from existing law; Words in underscored type are additions.
